1. Acceptance of Terms

By accessing and using Springboard ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use the Service.

2. Description of Service

Springboard is an HR survey platform that collects anonymous employee feedback and provides AI-powered analysis to identify themes, sentiment, and actionable insights. The Service includes survey creation, response collection, data analysis, and reporting features.

3. User Responsibilities

As a user of the Service, you agree to:

  • Provide accurate and truthful information when creating an account or responding to surveys
  • Not attempt to circumvent, disable, or interfere with security features of the Service
  • Not use the Service for any unlawful purpose or in violation of any applicable laws
  • Not attempt to gain unauthorized access to other users' accounts or data
  • Not submit content that is harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Not use automated systems or software to extract data from the Service without permission
  • Not attempt to reverse engineer, decompile, or disassemble any part of the Service

4. Content Moderation and Security

Automated Content Screening

All submissions are automatically screened for offensive content and attempts to manipulate our AI systems. Flagged content may not be processed.

To maintain the integrity of our Service and protect all users, we employ robust automated systems to detect and flag potentially harmful content. These systems are continuously improved to identify:

  • Offensive, abusive, threatening, or inappropriate language
  • Discriminatory content including hate speech or harassment
  • Prompt injection attempts designed to manipulate AI analysis
  • Attempts to extract system information or bypass security controls
  • Any content intended to compromise the accuracy or reliability of our AI systems

By using the Service, you acknowledge and agree that:

  • We reserve the right to refuse to process any content that our systems flag as suspicious, offensive, or potentially harmful
  • Flagged content may be excluded from analysis without prior notice
  • No refunds will be provided for content that is not processed due to being flagged by our security systems, even if the flagging is subsequently determined to be incorrect
  • Our automated detection systems, while robust and continuously improving, may occasionally flag legitimate content as suspicious—this does not entitle users to compensation or refunds
  • We may, at our sole discretion, review flagged content manually, but are under no obligation to do so
  • Repeated submission of flagged content may result in suspension or termination of your account

We invest significantly in maintaining and improving our content moderation systems to ensure a safe and reliable experience for all users. These measures are essential to providing accurate AI-powered analysis and protecting the integrity of survey results.

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

6. AI-Generated Content

Important Notice Regarding AI Analysis

The analysis, insights, recommendations, and visualizations provided by Springboard are generated using artificial intelligence technology. While we apply rigorous processes and quality controls to ensure accuracy, AI systems can make mistakes.

By using the Service, you acknowledge and agree that:

  • All analysis, themes, sentiment scores, recommendations, and diagrams are AI-generated
  • AI-generated content should be used as a starting point for understanding, not as definitive conclusions
  • Users should cross-reference AI-generated analysis and recommendations with the original survey responses
  • Important decisions should involve human review and judgment, not rely solely on AI outputs
  • Springboard is not liable for decisions made based on AI-generated content without proper verification

We continuously work to improve the accuracy and reliability of our AI systems, but we cannot guarantee that all outputs will be error-free. Users are encouraged to validate AI-generated insights against source data and apply professional judgment when interpreting results.

7. Service Availability

We strive to provide the Service with maximum uptime and reliability. However, you acknowledge that:

  • The Service may occasionally be unavailable for maintenance or updates
  • We do not guarantee uninterrupted or error-free operation of the Service
  • We will make reasonable efforts to notify users of planned maintenance in advance
  • We will work to resolve any service disruptions as quickly as reasonably possible

8. Data Protection & Regulatory Compliance

Compliance Commitment

Springboard is committed to compliance with the UK and EU General Data Protection Regulation (UK/EU GDPR) and the EU Artificial Intelligence Act 2024 (EU AI Act), which enters full application in 2026.

Data Deletion Rights

We believe you should always be in control of your data:

  • Survey respondents may delete their own survey responses at any time. However, any survey analysis already generated or reports downloaded by the survey owner prior to deletion will not be retroactively affected.
  • Survey owners (HR administrators) may delete all data associated with an individual survey, an entire survey collection, or their full account including all survey data, at any time.
  • When data is deleted, it enters a 30-day recovery period to protect against accidental deletion, after which it is permanently and irreversibly removed. Authentication credentials are deleted immediately.

Data Retention

Data is retained for as long as the survey owner's account is active. If a survey owner has not logged in for a period of two (2) years, their account and all associated data (including survey responses, analysis, and any derived data) will be automatically deleted.

AI Transparency (EU AI Act)

In accordance with the EU AI Act's transparency obligations:

  • All analysis, themes, sentiment scores, and recommendations generated by the Service are clearly identified as AI-generated content
  • Survey respondents are informed before submission that their responses will be analysed by AI
  • Springboard does not use AI to make automated decisions about individual employees — all AI outputs are advisory and require human review
  • We do not train AI models on your data. We use commercial AI services via API only, and your data is not retained by those providers for training purposes

9. Intellectual Property

The Service, including its design, features, and content (excluding user-submitted data), is owned by Springboard and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

You retain ownership of any content you submit to the Service. By submitting content, you grant Springboard a license to use, process, and analyze that content solely for the purpose of providing the Service to you.

10. Limitation of Liability

To the maximum extent permitted by law, Springboard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, if we believe you have violated these Terms and Conditions or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of material changes by posting the updated terms on the Service or by email. Your continued use of the Service after such changes constitutes acceptance of the new terms.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Springboard operates, without regard to its conflict of law provisions.
